  1. Introduction

These are the terms and conditions of Yoga Circle Amsterdam B.V., De Clercqstraat 66-68, 1052 NJ Amsterdam, (hereinafter “Yoga Circle“, “we” or “us“).

These terms and conditions (“Terms and Conditions“) apply to a student (hereinafter: “Student” or “you”) who attends a class, event, training, course or workshop with us and/or who visits our website www.yogacircle.nl (‘Website”) and/or who purchases a subscription or other product or service from us. By attending a class, event, training, course or workshop, and/or when you visit our Website and/or when you purchase a subscription or other product or service, you agree to the applicability of these Terms and Conditions.

  1. Class cards and Subscriptions

 

a) Yoga Circle offers the following class cards and subscriptions:

  • Trial offer – 3 class card

This 3 classes card can only be purchased once by new students only and is valid for 2 weeks after purchase date. The trial offer can be used for all classes.

  • Single class card

A single class card to be used within 1 month after purchase date. This card is valid for all classes (including the Mysore program).

  • 5 class card

A 5 class card is valid for a period 1 month after the date of the first booking. This card is valid for all classes (including the Mysore program).

  • 10 class card

A 10 class card is valid for a period 3 months after the date of the first booking. This card is valid for all classes (including the Mysore program).

  • Off-Peak Membership

The Off-Peak Membership provides access to all classes from Monday to Friday between 7:00 and 17:00 (excluding the Mysore program).

  • Unlimited Membership

The Unlimited Membership provides unlimited access to all classes (excluding the Mysore program).

  • Unlimited Mysore Membership

The Unlimited Mysore Membership provides unlimited access to all classes (including the Mysore program).

 

b) We are entitled to add different class cards or memberships or change the current offering at any time.

c) All class cards can be purchased online or in person at the yoga school (we only take card payments, no cash).

d) All our memberships require a minimum commitment of 3 full months. You can start your membership at any time, you will be charged a pro-rata amount to the end of the calendar month and thereafter billed the full amount monthly – for a minimum of three months – on the 1st of each month. After the first 3 full months, your membership continues for an indefinite period of time until you terminate your membership. After the first 3 full months, you can terminate your membership at any time (online), such with a termination period of 1 month, which termination period starts the first day of the month after the day you terminated your membership.

e) Memberships are charged via SEPA directly on your bank account and therefore can only be purchased online. When purchasing a membership, you give Eversports/Stripe, on behalf of Yoga Circle permission for direct debit of the subsequent instalments until further notice. The direct debit will take place on the first working day of the month. If the instalment payment due cannot be debited, for example because there is insufficient balance in the specified bank account at the time of debiting or because you have provided incorrect payment information, as well as in the event that you reverse the payment for a period, we will contact you via email or phone and ask you to come and pay the outstanding amount in person at the studio. You will be charged an extra five Euro (EUR 5) admin fees (the chargeback). Until the payment is received, you will not be able to make an online booking for a class or to attend a class. You continue to owe all expired term payments until the moment the membership has ended in accordance with these Terms and Conditions.

f) You are entitled to pause your membership with us for a period of 1 month per year. To do so, please send your request via email to [email protected] stating clearly which period you’d like to pause your membership. The paused period will be added at the end of your membership minimum commitment period. We can only pause your membership for a full calendar month at once (i.e., from the 1st day of a calendar month until the last day of the same calendar month).

g) If you purchase your membership online via the Website, you have the right to terminate your membership within 14 days after registration without cause, such by sending an e-mail to: [email protected]. If you decide to terminate your membership within the 14-calendar-day reflection period, and the membership has not been used during that period, this termination is free of charge. If you did use the membership during this period, we may charge a pro rata membership fee (from the activation of the membership until the day of the termination). You will be refunded as soon as possible, and no later than 14 days after receipt of your request to terminate your membership, using the same payment method you initially chose.

h) The applicable prices for classes, events, trainings, courses, workshops, class cards and memberships are always listed on the Website and can be viewed at our reception desk. We may change the prices at any time. Any changes will be announced in advance by us. In the event of a price increase, you have the right to terminate membership within 4 weeks of the announcement of that increase by us.

i) We have the right to refuse your request to purchase a class card or membership without giving reasons. A purchase of card or membership is established the moment Yoga Circle has received the payment due from the Student.

j) Class cards and memberships are not valid for events, trainings, courses and workshops, for which special prices apply, unless indicated otherwise on our Website.

  1. Schedule

 

a) All our classes, events, trainings, courses and workshops, including any changes thereto, will be announced on our Website.

b) Although we will try to avoid this at all times, we reserve the right to cancel classes, events scheduled and/or to substitute teachers announced. In such case, you are not entitled to a restitution or refund. We will try to inform students timely (via our Website or e-mail) about any cancellations or substitutions.

 

  1. Your booking with us

a) All classes, events, trainings, courses and workshops can be booked from the moment these are available on our Website until 5 minutes before the start thereof, unless fully booked or otherwise specified.

b) You can book a class via our Website or at our yoga school, such to the extent that (i) you have a valid class card or membership or have paid for the class in full when making such booking class and (ii) you have been registered with us.

c) You can book an event, training, course or workshop via our Website or at our yoga school, such to the extent that (i) you have paid for the event, training, course or workshop in full when making a booking and (ii) you have been registered with us.

d) To the extent a class isn’t fully booked, you can also drop by and join the class, such until 5 minutes before the start thereof and provided that (i) you have a valid class card, membership or have paid the class in full and (ii) you have been registered with us.

e) Students that wish to book a class with us via ClassPass, OneFIt or another similar third-party provider need to book via the platforms of such providers in accordance with the booking- and cancellation policies of these providers.

  1. Cancellation and no shows

a) Your booking is valid until 5 minutes before the class starts. If you haven’t shown up by then, we consider this a ‘no show’ and we are allowed to give your spot to someone else. Such a ‘no show’ will be registered and deducted from your class card (i.e., you will be charged a full class price).

b) In case you booked a class with us, cancellation thereof is only possible up to 3 hours prior to the start of the class so that somebody else can take your spot. A cancellation within 3 hours of class will be considered a ‘no show’. Such a ‘no show’ will be registered as a class attended and as such deducted from your class card.

c) In case of a no show or late cancellation, for whatever reason, no restitutions or refunds will be made. In case of three or more no shows/late cancellations in a month, we reserve the right to temporarily suspend your online bookings rights (i.e., you will then only be able to drop by for classes; in such case, article 3.d above is applicable).

d) In case you booked an event, training, course or workshop with us, cancellation thereof is possible up to 30 days prior to the start thereof, unless stated otherwise. In such case, you are entitled to a full refund (unless stated otherwise). Cancellations within 30 days of an event, training, course or workshop with us will not be refunded, but you are entitled to transfer your spot to someone else.

e) The cancellation and no show conditions from ClassPass, OneFIt or other similar third-party providers apply to students who have booked a class with us via these providers.

  1. House rules

All Students agree to adhere to the following house rules of Yoga Circle at all times:

  • Participation to all classes, events, trainings, courses or workshops is at your own responsibility.
  • If you have an injury or sickness, or if you are pregnant, please inform the teacher before the class starts. You are responsible for your own well-being, but the teacher is always happy to support you as needed.
  • Make sure to arrive at least 5 minutes before the start of a class, event, training, course or workshop in the yoga studio (doors generally open 15 mins before). Once the door is closed and the class has started, we won’t allow students in as this is disturbing for everyone else in the class. If you arrive after class start time, please note that you might not be allowed in the class. If you arrive less than 5 minutes before class start time, please note that your spot might be given away to any students waiting (waiting list).
  • We value silence. Please be mindful when talking to other people in the yoga studio before, during or after a class.
  • Switch off your mobile phone or set in on silent when entering the yoga studio.
  • Leave your shoes and personal belongings in the changing rooms. Don’t bring shoes, bags or mobile phones into the yoga shala.
  • Wear clean and comfortable loose sportswear or yogawear to join our classes.
  • We have yoga mats and props for you to use during classes. You are of course welcome to bring your own and store it (at your own risk) in the changing rooms.
  • At the end of a yoga class, you are kindly requested to clean the yoga mat and props you borrowed from us, as well as the floor where you have placed your yogamat if needed. Mat cleaners and paper are provided in the yoga shala. Put any props away tidily after your class, fold the blankets, store blocks neatly and roll up any straps used.
  • Come to practice clean. If you need to refresh yourself before joining the class, plan to take a quick shower before entering the yoga shala.
  • When you take a shower in our yoga school, keep it short – allowing also others to take a shower – and avoid using products with strong perfumes or fragrances.
  • For hygiene reasons, you are not allowed to shave in our yoga school.
  • You are welcome to hang out with a cup of tea before and after your class. Please be aware that glasses are not allowed in the yoga shalas.
  • We respect all students regardless of age, physical limitations, race, creed, gender, ethnicity, religious affiliation, or sexual orientation.
  • We avoid words and actions that constitute bullying and/or sexual harassment and do not tolerate such behaviour in our yoga studio.

  1. Liability

a) We don’t accept any liability (in any form whatsoever) for damages to or loss of your property, unless such damage or loss results from our negligence or our default.

b) We don’t accept any liability (in any form whatsoever) for damages in relation to physical and/or mental injury or injury resulting from your visit to our yoga school or your participation to our classes, events, trainings, courses or workshops, unless arising from our negligence or default.

c) Nothing in these terms and conditions is intended to limit any rights you may have as a consumer.

We process your personal data in accordance with our Privacy Notice, which can be found here.

  1. Complaints

If you have any complaints, we regret this but are of course happy to hear them. In the first instance, you can turn to our studio coordinators or our management in the yoga school. If you feel that your complaint has not been resolved, please write to [email protected] and we will get back to you.

  1. Governing law

 

a) These Terms and Conditions are exclusively governed by Dutch law.

b) Any disputes relating to these Terms and Conditions will be settled by the competent court in Amsterdam.
